But before you start planning your early retirement, here’s what has exactly happened and why it matters for the future of gaming history.
The DMCA Strikes Again
TheDigital Millennium Copyright Act(DMCA)has long been a thornin the side of video game preservationists. This piece of legislation, which was originally intended to protect copyright holders from digital piracy, has had some unintended consequences when it comes to preserving our gaming heritage.
Recently, theVideo Game History Foundation(VGHF), in collaboration with the Software Preservation Network (SPN), petitioned the U.S. Copyright Office to grant a new exemption to the DMCA. This exemption would have allowed libraries and archives to remotely share digital access to out-of-print video games in their collections. Sounds reasonable, right?

Unfortunately, the Copyright Office didn’t see it that way. In a decision that has left many in the gaming community scratching their heads, they denied the petition, effectively making it even harder for researchers and historians to access and preserve older games.

In other words, if you want to play a rare Wii U game for research purposes (or just for fun), you might have to go on a pilgrimage to Michigan or shell out big bucks on the secondhand market. And, of course,as time goes on and these consoles become scarcer, those prices are only going to go up.

While the Copyright Office’s decision is certainly a setback for video game preservation, it’s not the end of the road. As two commenters pointed out:
The fight to preserve our gaming history is far from over. Organizations like the VGHF and the SPNare continuing to advocate for changesto the DMCA that would make it easier for libraries and archives to do their important work.
